1. Acceptance

By accessing prakshar.com or contacting us through any form on this site, you agree to these Terms. If you do not agree, please do not use the site.

2. What this site is

prakshar.com is the marketing site of Prakshar, an independent software studio operating from Rajkot and Anand, Gujarat. The site describes our offerings, lets you contact us, and lets you apply to roles we are hiring for.

Submitting a contact or application form does not create a contract between you and Prakshar. A binding engagement begins only when both parties sign a written Master Services Agreement and a Statement of Work.

3. Acceptable use

You agree not to:

• Submit false, misleading, or impersonating information.
• Use the site to transmit malware, spam, or any content that is unlawful under Indian law.
• Attempt to disrupt, scrape at scale, reverse-engineer, or bypass any security control on the site.
• Use the site or our content to train commercial AI models without written permission.

4. Intellectual property

The Prakshar name, logo, site design, copy, and code are the property of Prakshar. You may not copy, republish, or reproduce them without written permission. Quoting short excerpts with credit and a link back is permitted.

Source code, deliverables, and IP created during a paid client engagement are governed by the relevant Statement of Work — not by these site Terms. Our standing policy is full client ownership of code, accounts, and content on delivery.

5. Submissions

Information you submit through forms (your enquiry, your application, attached portfolio link) is handled as described in our Privacy Policy. You confirm that the information you submit is your own, is accurate, and that you have the right to share it.

6. Third-party links

The site may link to third-party services (WhatsApp, LinkedIn, Instagram, X). We do not control those services and are not responsible for their content or privacy practices.

7. No warranty

The site is provided “as is” and “as available”. We make no warranty that the site will be uninterrupted, error-free, or that any information on it is current. Pricing, timelines, and offerings shown on the site are indicative and subject to change before any signed SOW.

8. Limitation of liability

To the maximum extent permitted by Indian law, Prakshar will not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the site. Our total aggregate liability arising from your use of the site (not including a signed paid engagement, which is governed by its own MSA) is capped at INR 1,000.

9. Indemnity

You agree to indemnify Prakshar against any claim arising from your breach of these Terms or your misuse of the site.

10. Governing law and jurisdiction

These Terms are governed by the laws of India. Any dispute arising out of or in connection with these Terms is subject to the exclusive jurisdiction of the courts at Rajkot, Gujarat.

11. Changes

We may update these Terms over time. The “Effective” date at the top reflects the latest version. Continuing to use the site after a change means you accept the updated Terms.
